Copyright Policy

Peaksur respects the intellectual property rights of others and expects users of the Service to do the same. This policy explains how to report copyright infringement on Peaksur and how we handle those reports under the Digital Millennium Copyright Act (17 U.S.C. § 512, the "DMCA").
1. Reporting infringement (DMCA notice)
If you believe content on Peaksur infringes your copyright, send a notice to our designated agent, the Copyright Manager (contact below). To be effective under the DMCA, your notice must include:
- Identification of the copyrighted work you claim is infringed (or a representative list if there are several);
- Identification of the infringing material and information reasonably sufficient for us to locate it (a link to the post, journal, or profile in the app or on the website);
- Your name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
- Your physical or electronic signature.
On receiving a valid notice we will remove or disable access to the identified material promptly and notify the user who posted it.
2. Counter-notification
If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notification to the Copyright Manager at the same address. It must include:
- Identification of the material that was removed and where it appeared before removal;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- Your name, mailing address, and telephone number;
- A statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the United States, the Eastern District of California), and that you will accept service of process from the person who filed the original notice or their agent;
- Your physical or electronic signature.
If we receive a valid counter-notification, we will forward it to the original complainant. Unless they notify us within 10 business days that they have filed a court action, we may restore the removed material within 10–14 business days.
3. Repeat infringers
Peaksur terminates, in appropriate circumstances, the accounts of users who are repeat infringers. We may also remove content and limit or terminate accounts for a single instance of infringement at our discretion.
4. Misrepresentation
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that content is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. Please make sure your notice or counter-notice is accurate before sending it.
